1. Acceptance of Terms

By accessing or using Tropo ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Tropo is a weather-market intelligence and decision-support tool. It provides probability estimates and public market context for contracts listed on Kalshi and similar regulated platforms. Tropo provides weather-market intelligence only. It does not execute trades, hold funds, or provide investment advice. Kalshi is a separate CFTC-regulated platform. Any decision to act on the information Tropo surfaces is yours alone and occurs directly on Kalshi or another venue outside Tropo.

3. Not Financial or Investment Advice

All probability estimates, weather-market intelligence, decision context, and natural-language summaries are model-generated estimates and may be materially inaccurate. Specifically:

• Our weather models may fail to predict unusual meteorological events
• Kalshi market prices may not behave as the model predicts
• Past model performance does not guarantee future results
• Any reference context is informational only and is not a recommended allocation

You are solely responsible for any market decisions and any resulting gains or losses. Always do your own research before acting outside Tropo.

4. Eligibility & User Accounts

• You must be at least 18 years old to use this Service
• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account and devices
• You may not share your account or allow others to access it
• Notify us immediately at [email protected] if you suspect unauthorized access

5. Acceptable Use

You agree not to:

• Attempt to reverse engineer, scrape, or excessively crawl the Service or its API
• Use automated tools to circumvent rate limits or abuse the API
• Impersonate other users or Tropo staff
• Use the Service to transmit malware or engage in any illegal activity
• Attempt to gain unauthorized access to other users' accounts or data
• Resell or sublicense access to the Service without written permission

6. Intellectual Property

All models, algorithms, code, and content on Tropo are the property of Tropo and its developers. You may not reproduce, distribute, or create derivative works without written permission. Your personal data and decision journal entries remain yours.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may suspend or terminate access for maintenance, abuse, or legal reasons. We will make reasonable efforts to provide advance notice of planned downtime.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant uptime, accuracy of model outputs, fitness for a particular purpose, or that the Service is free from errors or security vulnerabilities.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Tropo and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to market losses based on model outputs, loss of data, or business interruption. Our total liability shall not exceed the amount you paid us in the past 12 months (or $50, whichever is greater).

10. Indemnification

You agree to indemnify and hold harmless Tropo and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or any market decisions you make outside Tropo.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.

12. Changes to Terms

We may update these Terms at any time. For material changes, we will provide at least 30 days' notice to registered users by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Termination

We may suspend or terminate your account for violations of these Terms. You may delete your account at any time. Upon termination, your data will be deleted per our Privacy Policy.
